Description of Service

The Client named has contracted Erika T. Neal / DesignDiva Studios for the specific purpose of completing the project as detailed in the agreement/contract provided by DesignDiva Studios. By entering into the agreement with DesignDiva Studios, you agree to the terms of this document and other specific terms agreed upon, written or verbal.

Refund/Cancellation

Cancellations within 48 hours of order are entitled to receive a refund of deposit minus the non-refundable fee equal to the greater of $50.00 or 10% of deposit amount. Refunds will be processed within 10 business days. Cancellations made beyond 48 hours from the time of order forfeit deposit funds in the amount of 50% of the project cost less a $25.00 cancellation fee. If full payment for the project was made, the client is entitled to receive a refund of 50% of the total amount paid less a $25.00 cancellation fee. The order date on the date that the deposit payment clears.

Shipping

Any physical items or products purchased will be shipped via the most cost-effective and efficient shipping method. An estimated time of arrival can be provided if requested, but DesignDiva Studios cannot guarantee a date of arrival. Shipping prices are listed in contract pricing. Rush shipping, insurance, signature requirement and any additional shipping fees requested by the Client will be paid for by the Client. DesignDiva Studios will use the shipping address submitted by the Client, and we are not liable for any errors in shipping address provided. DesignDiva Studios will use contact details and reasonable means to rectify missing or lost packages, but we will not be liable for such incidents.

Force Majeure

DesignDiva Studios shall be excused from any delay or failure in performance required hereunder if caused by reason of any occurrence or contingency beyond its reasonable control, including, but not limited to, acts of God, acts of war, fire, insurrection, strikes, lock-outs or other serious labor disputes, riots, earthquakes, floods, explosions or other acts of nature.

Limitation of Liability

The Client acknowledges and agrees that DesignDiva Studios will not be liable for any losses or damages, whether indirect, incidental, special or consequential, in profits, goods or services, irrespective of whether or not the Client has been advised or otherwise might have anticipated the possibility of such loss or damage.

No Guarantee

The client acknowledges and agrees that DesignDiva Studios cannot guarantee the results or effectiveness of any of the services rendered or to be rendered. Rather, services shall be executed in a professional manner and in accordance with good industry practice. Best efforts will be used but no results are promised.
